Preços, pagamento, faturamento :

3. Se um espaço de estacionamento for disponibilizado ao cliente, isso não levará a um contrato de custódia. A Quinta Portugo não se responsabiliza pela perda ou dano de veículos a motor estacionados ou manobrados nas propriedades da Quinta Portugo e seu conteúdo, exceto no caso de intenção ou negligência grave. O mesmo se aplica aos agentes indiretos da Quinta Portugo.

AGBs und Haftungsauschluss
Reservierungen :
Schriftliche Reservierungen (per Email, Kontaktformular) sind verbindlich. Es muss eine Anzahlung geleistet werden.
Stornierungsbedingungen :
Reservierungen können vier Wochen vor dem Ankunftstag kostenfrei storniert werden. Danach fällt eine Stornierungsgebühr in Höhe der Anzahlung an. Vorzeitige Abreisen werden nicht erstattet. Bei Nicht-anreise ohne Stornierung sind wir berechtigt, den gesamten vereinbarten Betrag einzufordern.
Zahlungen :
Bei einer verbindlichen Buchung muss eine Anzahlung in Höhe von 20% auf unser Konto angezahlt werden. Bei Anreise ist der Restbetrag zu zahlen (z.Z. nur Barzahlungen) oder im Voraus auf unser Konto zu überweisen (Bitte stellen Sie in diesem Fall sicher, dass der Betrag rechtzeitig auf unserem Konto eingeht).
Umfang :
1. Diese Geschäftsbedingungen gelten für Verträge über die Vermietung von Betten für Unterkünfte und alle anderen Dienstleistungen und Lieferungen, die Quinta Portugo dem Kunden bietet.
2. Die Untervermietung oder Untervermietung der zur Verfügung gestellten Zimmer und deren Nutzung für andere Zwecke als die Unterbringung bedarf der vorherigen schriftlichen Zustimmung von Quinta Portugo.

Partnerhaftung, Beschränkung :

2. Vertragspartner sind Quinta Portugo und der Auftraggeber. Wenn ein Dritter den Kunden bestellt hat, ist er gegenüber Quinta Portugo zusammen mit dem Kunden als Gesamtschuldner für alle Verpflichtungen aus dem Hostelvertrag verantwortlich, sofern Quinta Portugo eine entsprechende Erklärung des Dritten erhalten hat.
3. Quinta Portugo ist für die vertraglichen Verpflichtungen verantwortlich. Im nicht typischen Dienstleistungsbereich beschränkt sich die Haftung auf Vorsatz und grobe Fahrlässigkeit von Quinta Portugo.
4. Die Verjährungsfrist für alle Kundenbeschwerden beträgt 6 Monate.
5. Diese Haftungsbeschränkung und die kurze Verjährungsfrist gelten zugunsten von Quinta Portugo, auch bei Vertragsverletzung zu Vertragsbeginn und positiver Vertragsverletzung.
Preise, Zahlung, Verrechnung :
1. Quinta Portugo ist verpflichtet, die vom Kunden gebuchten Zimmer / Betten verfügbar zu halten und die vereinbarten Leistungen zu erbringen.
2. Der Kunde ist verpflichtet, die aktuellen oder vereinbarten Preise von Quinta Portugo für die Bereitstellung von Zimmern und die anderen von ihm genutzten Dienstleistungen spätestens bei der Ankunft zu zahlen. Dies gilt auch für die vom Kunden an Dritte verursachten Leistungen und Aufwendungen von Quinta Portugo.
3. Die vereinbarten Preise enthalten die jeweilige gesetzliche Mehrwertsteuer.
4. Quinta Portugo kann die geltenden Preise ändern, wenn der Kunde später die Anzahl der gebuchten Zimmer, die von Quinta Portugo erbrachten Leistungen oder die Aufenthaltsdauer der Gäste ändern möchte und Quinta Portugo zustimmt.
5. Quinta Portugo-Rechnungen ohne Fälligkeitsdatum sind innerhalb von 5 Tagen nach Erhalt der Rechnung vollständig zu zahlen. Quinta Portugo ist berechtigt, aufgelaufene Ansprüche jederzeit zu verlangen und eine sofortige Zahlung zu verlangen. Bei Zahlungsverzug ist Quinta Portugo berechtigt, Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz zu berechnen. Rücktritt von Quinta Portugo :

Haftung von Quinta Portugo :

Quinta Portugo is entitled to demand accrued claims at any time and to request immediate payment. In the event of late payment, Quinta Portugo is entitled to charge interest at a rate of 5 percentage points above the base rate. The customer reserves the right to prove a lower, Quinta Portugo a higher damage.
6. Quinta Portugo is entitled to request a reasonable advance payment or deposit upon conclusion of the contract or thereafter, taking into account the legal provisions for package tours. The amount of the advance payment and the payment dates can be agreed in writing in the contract.
7. The customer can only offset or reduce an undisputed or legally binding claim against a claim by Quinta Portugo.
Quinta Portugo resigns: :
1.If a customer's right of cancellation has been agreed in writing within a certain period, Quinta Portugo is entitled to withdraw from the contract during this period, if, at Quinta's request, there are inquiries from other customers regarding the contractually booked rooms and the customer, Portugo does not have their right of cancellation canceled.
2. If an agreed advance payment is not made even after a reasonable grace period set by Quinta Portugo with imminent rejection, Quinta Portugo is also entitled to withdraw from the contract.
3. In addition, Quinta Portugo is entitled to extraordinarily withdraw from the contract for objectively justifiable reasons, for example if force majeure or other circumstances for which Quinta Portugo is not responsible make it impossible to fulfill the contract.
4. Quinta Portugo must inform the customer immediately about the exercise of the right of withdrawal.
5. If Quinta Portugo rightfully withdraws, the customer is not entitled to compensation.
Quinta Portugo's liability :
1. Quinta Portugo is responsible for the care of a prudent businessman. This liability is not typical for services in this area, but is limited to performance defects, damage, consequential damage or malfunctions that are attributable to intent or gross negligence on the part of the hostel in the city. If errors or defects occur in the Quinta Portugo services, Quinta Portugo will endeavor to remedy the situation if the customer becomes aware of it or if the customer informs it immediately. The customer is obliged to make a reasonable contribution in order to remedy the fault and to limit possible damage to a minimum.
2. The customer is aware that a special feature of the service provider's accommodation is that multi-bed rooms are rented, the guests of a multi-bed room share a key and thus people other than the guest themselves have access to the room. The service provider offers the storage of valuables. If valuables are brought in by the service provider, the liability of the service provider is based on the statutory provisions. The service provider is not liable for loss or theft from luggage storage or cloakroom. Liability claims expire if the customer does not report Quinta Portugo immediately
3. If a parking space is made available to the customer, this does not lead to a custody contract. Quinta Portugo is not liable for the loss or damage of motor vehicles parked or maneuvered on Quinta Portugo's property and their contents, except in the event of intent or gross negligence. This also applies to vicarious agents of Quinta Portugo.
